My letter to Armando Gonzalez February 27, 2014

Subject: My opposition to granting a license for the SALE OF ALCOHOLIC BEVERAGES at proposed gas station and market, State Lane, Big Bear City, California

Parcel Number and Project Number: 0315-231-17; P201300086 (Erwin Lake Market).

"The mission of the Department of Alcoholic Beverage Control is to administer the provisions of the Alcoholic Beverage Control Act in a manner that fosters and protects the health, safety, welfare, and economic well being of the people of the State."

Mike Maida owner of the parcel plans to build a 5,000-square-foot market and an 8 pump Chevron gas station on the site. Plans have been submitted to San Bernardino County and are working their way through the process. Located in a commercial development zone nevertheless the facility will invade what is now, a pine forest in front of residential single family houses. There are no other commercial businesses in the Erwin Lake sector.

There are numerous homes in Erwin Lake so the traffic on State Lane, exiting to Highway 38 is significant during daylight hours. There is a larger population on weekends and holidays as is true of the entire Big Bear Valley. At present, liquor buyers either bring their own driving up to Big Bear or drive 2 to 3 miles to the nearest liquor stores. Which are:

I've lived in Big Bear since August 2009 and have not purchased any alcoholic beverage. I have lived in a house full time in Erwin Lake I bought in October 2010.

At an organizatioal meeting of 14 on Feb 21, 2013 I learned that the proposed market will be located within 500 ft of the nearest Big Bear Valley School District bus stop. Their buses take students to all grades, K-1 to high school. Marta, the local bus service has a stop, also within 500 feet of the proposed facility. The school superintendent asked me to keep him informed of the proposed facility.

I live at 2182 2nd Lane, near Willow Lane and walk the area for 45 minutes or more daily. I detect weekenders often consume alcholic beverages from observing their trash.

The proposed gas station market will be within easy walking distance or a short bus ride of unlicensed or suspended persons of driving age. MARTA has strict rules about carrying inebriated passengers.

The proposed gas station/market is at one end of a long commercially zoned strip along highway 38 which is a state scenic corridor with concomitant restrictions. I can envision based on experience that before that commercial zone is developed, it could become a hangout for consumption of alcholic beverages and drug usage, in the old days, a "bum's camp" .

The proprietess, Yvonne Kurzeja informed us at the February 21st meeting at the facility that dementia was the most common ailment of her residents. Her facility is located where her residents should experience peace and tranquility. Lights from traffic coming out of the gas station/market will shine on the windowed front of the residence. The gas station/market has stated it won't close till 11 pm 7 days a week. There are at most only five streetlights in the Erwin Lake residential area and only at the most active intersections.

There is very little crime in the Erwin Lake area which can be verified at the following site: Crime mapping enter 2182 2nd Lane which is about in the center of the community.

From my experience, being in charge of the Downey California Police Department Services Division from 1974-1979, areas near liquor stores are subject to higher numbers of domestic violence and other alcohol fueled incidents.
